Director – Discovery Strategy & Management

Diane has 20 years of experience as a practicing attorney working complex litigation matters, including intellectual property, securities litigation, antitrust, and construction. She was an “early adapter”, and has conducted ESI discovery, large scale and small, for over 14 of her years in practice. 

As a consultant, Diane specializes in assisting clients with ESI discovery strategies, particularly focusing on how to use civil procedure rules (state or federal) to obtain and produce ESI discovery. Her practice includes assisting counsel in the creation of cost efficient ediscovery plans; negotiating e-production issues with opposing counsel; drafting and conducting effective ediscovery; technical deposition preparation and assistance; presenting ESI issues to courts and discovery referees.  Diane assists clients with large scale document review projects, including selection of review tools, planning and management of non-linear review; review team management.  Diane has personally managed review projects in the United States and offshore in India.  

In addition to litigation related engagements, Diane’s practice also includes assisting clients with internal investigations, litigation preparedness programs, and document retention programs.

Diane is a chapter author for Matthew Bender legal publishing, She is the sole author of 5 chapters in MB’s California Ediscovery & Evidence practice guide: (1) Ethical Issues for Attorneys in E-Discovery; (2) Discovery of ESI Residing in Foreign Jurisdictions; (3) Establishing Best Practices Regarding Electronically Stored Information (4) E-Discovery Deposition Practice; (5) Admissibility of ESI at Trial.  She is the co-author of chapter 1 of that guide, on “Understanding Electronic Evidence.” Diane is also regular speaker and panelist on ESI discovery.  Recent speaking engagements include Ethics & Ediscovery – Alameda Bar Association (upcoming – August 2010); Admissibility of ESI – The American Bar Association 4th Annual EDiscovery Institute (May 2010); Ethics & Ediscovery – Webcast for LexisNexis (December 2009); 30(b)(6) Depositions – the Guidance Software Computer & Enterprise Investigation Conference (May 2009).
